Limited Warranty

 

Your Tinsel® product is guaranteed against manufacturing defects for a period of ninety (90) days from the date of its original retail purchase from an authorized Tinsel retailer (the “Warranty Period”).

REMEDIES

If a product defect exists, Tinsel, at our discretion, will either:

  • Repair the product using new or refurbished parts;
  • Exchange the defective product with a functioning equivalent product that may be new or refurbished, or;
  • Refund the original purchase price.

In the event of a defect, to the extent permitted by law, these are your sole and exclusive remedies. Shipping and handling charges may apply except where prohibited by applicable law.

Any replacement hardware product will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer, or for any additional period of time that may be applicable in your jurisdiction.

This limited warranty grants you specific legal rights, and you may also have other rights that vary by states or jurisdiction. These rights will not be affected by this warranty.

This warranty is only extended to the original end-use purchaser or person receiving the product as a gift. It cannot be extended to any other person or transferee. Proof of purchase is required to verify eligibility for this warranty and any recovery is limited to the original purchase price.

HOW TO OBTAIN WARRANTY SERVICE

To obtain limited warranty service, fill out the form at tinsel.me/support

The product must be returned in either its original packaging or packaging providing an equal degree of protection, to the address specified by Tinsel. You agree to pay the cost of shipping the product to Tinsel. By sending the product, you agree to transfer ownership to Tinsel. If the claim is justified based on this limited warranty, Tinsel shall bear the cost of shipping the repaired or replacement product to you. Any product returned to Tinsel without a valid warranty claim may be rejected, returned at sender’s cost (subject to prepayment) or kept for thirty (30) days for sender’s pick-up and then disposed of in Tinsel's sole discretion. In accordance with applicable law, Tinsel may require that you furnish proof of purchase details and/or comply with registration requirements before receiving warranty service.

Failure to register your product will not affect your rights under this warranty.

EXCLUSIONS AND LIMITATIONS

This Limited Warranty applies only to the original purchaser of product that was purchased from tinsel.me and manufactured by or for Tinsel that can be identified by an authorized “Tinsel” trademark, trade name, or logo. Without limiting the foregoing, the Limited Warranty does not apply to any (a) Tinsel products and services other than the product, (b) non-Tinsel hardware product, including without limitation any knock off or counterfeit version of a product, (c) product that is, or Tinsel reasonably believes to be, stolen.

This warranty does not apply to a product or part of the product that has been altered or modified by anyone who is not a representative of Tinsel. Customizing the product will void your warranty. In addition, this Limited Warranty does not apply:

(a) to damage caused by use with non-Tinsel products; (b) to damage caused by accident, abuse, improper use, excess moisture, flood, fire, earthquake or other external causes; (c) to damage caused by operating the product outside the permitted or intended uses described by Tinsel (d) to damage caused by modifications made to the product or service performed by anyone who is not a representative of Tinsel; (e) to normal wear and tear (f) to loss or theft.

This warranty is void if a product is returned with any alterations (including the unauthorized removal of any component).

No Tinsel reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

A special note to our international customers: Due to the high cost of shipping abroad, we regrettably are unable to process exchanges outside of the U.S. and Canada. However, we are still here to help with troubleshooting any issues you may have. Please contact our support team at support@tinsel.me if you have trouble with your unit.

IMPLIED WARRANTIES

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY. Some jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

LIMITATION OF DAMAGES

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, TINSEL SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, EVEN IF TINSEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL OR EQUITABLE THEORY. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.
